TERMS AND CONDITIONS FOR PRODUCT PURCHASE

1. Introduction

These Terms and Conditions govern the sale of products by Laser Technology (Asia) Limited ("the Company") to the customer ("the Customer"). By placing an order, the Customer agrees to these Terms. In case of discrepancies in translations, the original English version shall prevail.

 

 2. Product Information

  • All product descriptions, specifications, images, prices and other information are subject to change without notice.

  • The Company makes every effort to ensure that the information provided is accurate; however, errors may occur.

  • The Company reserves the right to correct typographical or system errors that may result in inaccurate pricing or descriptions.

 

3. Pricing and Payment

  • All prices are listed in Hong Kong dollars (HKD) and exclude delivery fees, import taxes, customs duties, VAT/GST/sales taxes and/or handling fees charged by the carrier.

  • The Customer will be charged and paid in Hong Kong dollars (HKD).

  • The Customer is encouraged to contact their local customs office and carrier before placing an order to avoid unexpected charges.

  • Payment must be made at the time of order via accepted payment methods.

  • All payments are processed independently by third-party services. The Company is not responsible for any errors, delays, or issues arising during payment processing by these third-party entities.

  • If payment fails or is refused by the payment service provider, the Company shall not be obligated to fulfill the order.

  • By using the payment services, the Customer agrees to abide by the terms and conditions imposed by the third-party payment service providers.

 

4. Orders and Acceptance

  • Orders can be placed on the Company’s website.

  • Orders will be processed within five (5) business days if stock is available. For backordered items, processing times may take up to two (2) months. Customers are encouraged to contact the Company via email to confirm the estimated processing times and stock availability before placing an order.

  • The Company reserves the right to offer a substitution or cancel any order with a refund for any reason, including product availability or errors in pricing.

 

5. Shipping and Delivery

  • The Company will ship products to the address provided by the Customer during order placement.

  • The Customer must verify the shipping address and confirm delivery service is available before confirming the order.

  • Delivery times are estimates and may vary based on the selected shipping method.

  • Additional personal information may be required to fulfill delivery requirements in certain countries.

  • Customers may opt for shipping insurance at their own cost to protect against potential loss or damage during transit.

  • Shipment tracking information will be sent to the email address provided by the Customer when placing the order. Please make sure the email address is correct and valid for communication purposes.

  • Customers are responsible for ensuring compliance with any import or export controls in the destination country.

  • The Company is not responsible for any loss, damage, or delay that may occur after goods have been accepted for shipment by the carrier.

  • If the goods are not received, collected, or refused by the Customer within the specific timeframe, they will be returned to the Company. The Company reserves the right to charge the Customer for any additional handling, return fees, or shipping costs incurred for a second delivery attempt.

 

6. Inspection and Reporting issues

  • The Customer is required to inspect the products upon delivery and report any issues (e.g., damages or discrepancies) within five (5) business days to be eligible for assistance or remedies. Claims must be reported via email or the Company’s online form, along with supporting documents such as photos or receipts.

  • If the issue is determined to be a manufacturer defect, the Company may consider offering a replacement, exchange, or refund at its discretion, subject to Cobalt’s warranty guidelines.

 

7. Returns, Refunds, and Warranty

  • Once an order is confirmed and payment is made, it cannot be changed, canceled or refunded, except in cases governed by warranty.

8. Force Majeure

The Company shall not be held responsible for delays or failures in fulfilling orders due to events outside its control, such as natural disasters, strikes, pandemics, cyberattacks, government actions, or other unforeseen circumstances.

 

9. Limitation of Liability

  • The Company is not liable for any indirect, incidental, or consequential damages arising from the use of any product purchased.

  • The Company’s total liability, where applicable, is limited to the value of the product purchased.

 

10. Acceptable Use

  • Products may only be used for their intended purposes and in compliance with these Terms and applicable laws.

  • The Customer is solely responsible for ensuring that product use does not violate any laws, regulations, or third-party rights.

  • The Customer agrees to indemnify and hold the Company harmless against any claims, losses, or damages arising from misuse of the products.

 

11. Intellectual Property

All product designs, trademarks, and related intellectual property remain the exclusive property of Cobalt or its licensors and must not be used without authorization.

 

12. Governing Law

These Terms and Conditions are governed by the laws of the place where the Company is based, Hong Kong Special Administrative Region (“HKSAR”), without regard to conflict of laws principles.

 

13. Disputes

The Company and the Customer agree to attempt to resolve any disputes amicably. Should agreement not be reached, then the parties agree to Hong Kong Special Administrative Region (“HKSAR”) as the appropriate jurisdiction for resolution of any disputes.

 

14. Changes to Terms

The Company reserves the right to modify these Terms and Conditions at any time. Customers will be notified of significant changes.

 

15. Privacy Policy and Data Collection

16. Language and Translations

In case of discrepancies between translated versions of these Terms, the original English version shall prevail.
